H-2A Seasonal Agricultural Visas

Looking for temporary work in the United States?

The United States Citizenship and Immigration Services (USCIS) provides H-2A visas for workers who immigrate to the United States to fill temporary agricultural positions. The sponsoring employer must meet certain requirements in order to receive H-2A visa classification. The job itself must be temporary or seasonal, and there must be too few qualified U.S. workers in the area to meet the employer's needs. The employer must be able to show that the wages of similarly employed U.S. workers will not be affected by hiring temporary immigrant workers and must have labor certification from the U.S. Department of Labor.

Completing the H-2A Visa Process

Once the employer has become certified to hire on temporary workers with H-2A visas, the company must complete Form I-129, Petition for Nonimmigrant Worker and submit it to the USCIS along with proof of their labor certification. Workers outside of the country looking for temporary or seasonal agricultural work in the U.S. can then apply for an H-2A visa at their local U.S. Embassy or Consulate or, if they do not require a visa, can seek direct entry in H-2A classification with Customs and Border Protection at a U.S. port of entry.
