EB-2 Professional Worker Visas

Advanced Degrees, Exceptional Ability & National Interest Waivers

There are five types of employment-based permanent resident visas, one of which is the EB-2 professional worker visa. As with any employment visa, the applicant must meet extensive criteria to prove that they are eligible for an EB-2 visa. Depending on the sub-category that you fall under, you may be required to apply for a job that requires an advanced degree or demonstrate exceptional ability and meet 3 of 10 criteria. Some EB-2 applicants may request a national waiver of interest that does not require sponsorship from an employer with labor certification, but they must still meet several of the criteria, which include:

  • Official academic degree, diploma, certificate, or similar award from a college, university, school, or other institution of learning relating to your area of exceptional ability
  • At least 10 years of documented, full-time experience in your occupation
  • A license to practice your profession or certification for your profession or occupation
  • Evidence that you have commanded a salary or other remuneration for services that demonstrates your exceptional ability
  • Membership in one or more professional associations
  • Recognition for your achievements and significant contributions to your industry or field by your peers, government entities, professional or business organizations
  • Other comparable evidence of eligibility may also be acceptable
