EB-1 Priority Worker Visas

Employment Visas for Persons of Extraordinary Ability

Individuals who demonstrate extraordinary ability in science, art, education, business, or athletics; who are outstanding professors and / or researchers; or who are multinational managers or executives are eligible to receive permanent, employment-based residency in the United States through an EB-1 visa. These individuals must have sustained national or international acclaim for their ability and must meet 3 of 10 criteria specific to individuals of extraordinary ability, outstanding professors or researchers, or multinational managers or executives in order to qualify for an employment-based visa.

Some employment-based visas require the sponsorship of a U.S. employer that has obtained labor certification. Immigrants with extraordinary ability do not require sponsorship and may file their own Form I-140, Petition for Alien Worker, but all other EB-1 priority workers must have a job offer from a U.S. employer. The employer must file the Form I-140 on the worker's behalf.
